Terms of Service

1. Acceptance

By downloading, installing, accessing, or using CareMeds, you agree to these Terms of Service. If you do not agree, do not use the app.

These terms apply to the CareMeds mobile application, related app features, and caremeds.app pages that support the app.

2. Medical Disclaimer

CareMeds is an organizational and informational medication-management tool. It is not a doctor, pharmacist, medical provider, pharmacy, insurer, emergency service, or substitute for professional medical judgment.

CareMeds does not diagnose, treat, cure, or prevent any disease or medical condition. It does not prescribe medications, dispense medications, or create a patient-provider relationship.

Always speak with a physician, pharmacist, or other qualified healthcare professional before starting, stopping, skipping, changing, or combining medications. In an emergency, call emergency services immediately.

3. What CareMeds Does

• Helps users and caregivers create medication profiles, patient profiles, routines, and schedules.
• Provides reminders, notification actions, iOS Live Activities, and adherence logging for scheduled or as-needed medication use.
• Supports caregiver coordination through invitations, linked patient profiles, permissions, caregiver alerts, and shared medication information.
• Uses medication databases and AI-assisted workflows to help identify medications, read labels, suggest schedules, flag potential safety concerns, and explain missed-dose or timing considerations.
• Provides subscription and entitlement features through RevenueCat where premium features are offered.

4. What CareMeds Does Not Do

• CareMeds does not guarantee that medication information, AI output, reminders, schedules, or safety checks are complete, current, or correct.
• CareMeds does not detect every drug interaction, duplicate therapy, allergy issue, contraindication, side effect, dose issue, or timing concern.
• CareMeds does not replace a medication label, prescriber instructions, pharmacist counseling, clinical judgment, or emergency care.
• CareMeds does not guarantee notification delivery, caregiver response, dose adherence, or health outcomes.

5. AI and Safety Information

CareMeds uses AI-assisted processing and medication information sources such as RxNorm, openFDA, and DailyMed. AI-generated output and database-derived information are informational only and may be incomplete, outdated, or wrong.

You must independently verify medication schedules, warnings, interactions, missed-dose recommendations, and safety information with a qualified healthcare professional. Do not rely on CareMeds as the only safety check for a medication decision.

6. Your Responsibilities

• Enter accurate and current medication, dosage, schedule, allergy, condition, caregiver, and profile information.
• Review and confirm scanned or AI-extracted medication label details before relying on them.
• Confirm medication schedules and instructions with the prescribing clinician or pharmacist.
• Maintain a backup medication-management system such as the original prescription label, pill organizer, written list, pharmacy records, or caregiver process.
• Keep your account secure and use only caregivers who are authorized and trustworthy.
• Seek medical care promptly when needed and call emergency services for urgent symptoms or emergencies.

7. Caregiver Use

If you use CareMeds for another person, you represent that you have permission and authority to manage or assist with that person's medication information. The patient's healthcare professionals remain the clinical authority.

Caregiver features can expose sensitive medication, adherence, and patient-profile information to invited caregivers. You are responsible for choosing appropriate caregivers and reviewing their permissions.

8. Notifications and Live Activities

Medication reminders, time-sensitive alerts, caregiver alerts, notification actions, and Live Activities depend on device settings, operating-system behavior, permissions, battery restrictions, connectivity, app state, and third-party notification services.

Notifications may be delayed, hidden, fail to deliver, display sensitive medication details, or be unavailable. CareMeds includes notification privacy controls, but you are responsible for configuring your device and maintaining a backup system.

9. Accounts and Access

• The app may create an anonymous Firebase session before a user upgrades to an email/password account.
• You are responsible for all activity under your account and for keeping credentials secure.
• You may not access another person's medication information unless you have authorization.
• We may suspend or terminate access if we believe the app is being misused, accessed unlawfully, or used in a way that creates risk for users, CareMeds, or the service.

10. Subscriptions and Purchases

CareMeds may offer paid features or subscriptions through Apple, Google, RevenueCat, or another payment provider. Pricing, renewal, cancellation, refunds, and store-account management may be controlled by the applicable app store or payment provider.

Subscription access depends on entitlement status reported by the payment provider and reflected in the app. You are responsible for managing renewals and cancellations through the applicable store or customer center.

11. Privacy

Your use of CareMeds is also governed by the CareMeds Privacy Policy at caremeds.app/privacy. The Privacy Policy explains the health data, account information, identifiers, diagnostics, purchase information, AI processing, and caregiver sharing involved in the app.

12. Prohibited Uses

• Do not use CareMeds to provide professional medical advice unless you are properly licensed and independently responsible for that advice.
• Do not reverse engineer, attack, scrape, overload, bypass security, or interfere with CareMeds systems.
• Do not enter information you do not have authority to enter or share.
• Do not use CareMeds for unlawful, harmful, fraudulent, or abusive activity.

13. No Warranties

CareMeds is provided on an as-is and as-available basis. To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

14. Limitation of Liability

To the maximum extent allowed by law, CareMeds and its operators are not liable for personal injury, medication errors, missed doses, adverse events, health complications, data loss, unauthorized access, notification failures, AI errors, schedule errors, or indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the app.

To the maximum extent allowed by law, our total liability for any claim related to CareMeds will not exceed the greater of the amount you paid for CareMeds in the 12 months before the claim or 100 US dollars.

15. Indemnification

You agree to defend, indemnify, and hold CareMeds harmless from claims, damages, liabilities, costs, and expenses arising from your misuse of the app, inaccurate information you enter, unauthorized sharing, caregiver actions you permit, violation of these terms, or violation of law.

16. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where local consumer law requires otherwise.

17. Changes

We may update these terms as CareMeds changes. If we make material changes, we will provide notice through the app, website, or another appropriate method. Continued use after an update means you accept the updated terms.
